GENERAL TERMS AND CONDITIONS FOR THE PROVISION OF THE ONLINE GROUP COACHING PROGRAM

2. Application
2.1. These terms and conditions (hereinafter: the Terms and Conditions) apply to all agreements with all persons and companies who contact Business4Good via the Website to participate in Business4Good's online group coaching Program (hereinafter: 'the Program') (hereinafter: 'the Participants'). By enrolling in the Program, the Participant declares to fully and unconditionally agree to these Terms and Conditions.
2.2. Business4Good reserves the right to make unilateral changes to these Terms. The current version of the Terms and Conditions will always be available on the Website via https://blush2bloom.com
2.3. Any person accessing the Website declares to be of legal age and to have full legal capacity. If you do not meet these requirements, please leave the Website immediately.
3. Right of Withdrawal
3.1. Insofar as the Participant is a natural person consumer, the Participant may invoke the following right of withdrawal:
The consumer has a right to notify Business4Good within 14 days from the day of the conclusion of the service agreement that he renounces the purchase without payment of a penalty and without giving any reason. This means that the Participant can cancel his registration.
If the Program has already started within this 14-day reflection period, the Participant gives his/her express prior consent to the performance of the service agreement by participating in the Program and declares that he/she waives his/her right of withdrawal. Where applicable, no refund of the subscription amount will follow.
3.2 In order to exercise the right of withdrawal from Articles 3.1 you must inform us of your decision to withdraw from the contract by an unequivocal statement (e.g., in writing by post or e-mail). To comply with the withdrawal period, it is sufficient to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
3.3 If you withdraw from the contract, we will refund all payments made by you up to that point without delay and in any event no later than 14 days after we have been informed of your decision to withdraw. We will reimburse you using the same means of payment with which you made the original transaction, unless you have expressly agreed otherwise; in any event, you will not be charged for such reimbursement.
4. Practical Information about the Program
4.1 The Program has a duration of 6 weeks and contains 6 sessions.
4.2 Every session of the Program will take place via a videoconferencing platform and will be recorded.
The Program can be followed in two ways:
- a Participant can choose to participate live to the sessions of the Program. The Participant will have access to the recordings of each session as well;
- a Participant can choose not to participate live to the sessions of the Program, but to watch only the recordings.
4.3 The Participant shall have access to a Portal on which relevant documents for the Program can be found.
4.4 The Participant will have access to the Portal and the recordings of the Program during the term of the Program and for four months after the Program has ended.
5. Obligations of Business4Good - Disclaimer
5.1. The advice, guidance, mentoring and coaching provided by Business4Good must not be seen as a substitute for medical advice.
5.2 All obligations of Business4Good are best effort obligations. Business4Good offers no guarantees regarding the results of the Program for the Participant. Hence, Business4Good cannot be held liable if the Participant is not satisfied about the result of the Program. Business4Good only offers a full refund of the subscription amount to the Participant if the conditions specified in Article 9 are fulfilled.
5.3. Business4Good is also not liable for any damage suffered by the Participant as a result of his participation in the Program, or caused during the Program.
5.4. Business4Good is only liable towards the Participant for the damage caused by a deliberate error or gross negligence of Business4Good or one of its appointees. The Participant must provide proof of this. The liability of Business4Good is limited to the direct damage of the Participant (excluding indirect damages) which can never exceed the price of the registration by the Participant for the Program in the framework of which the damage occurred.
6. Full Refund Under Conditions
6.1 Business4Good offers a full refund of the subscription amount to the Participant if the Program does not meet its expectations after the two first weeks of the Program. Such refund is only possible if the following conditions are fulfilled:
- the Participant has followed the two first sessions of the Program (be it live or via the recording);
- the Participant has done the home work of the two first weeks of the Program in a decent way;
- the Participant sends his request to end the Program at the latest [3 days] before the start of the third session (in case of a live participation to the Program) or before the link to watch the recording of the third session is activated (in case of a participation to the Program by only watching the recordings).
7. Intellectual Property
7.1. The concept of the Program, the content of this Website, as well as the trademarks, logos, trade names, illustrations, page design, the data made available, the texts, images, as well as the software used in connection with the Website are protected by intellectual property rights belonging to Business4Good or third parties whom Business4Good has entered into an agreement with.
All works related to the Program (hereafter: Works), including, but not limited to books, slides, handouts, course materials, scripts, homework and other material (both in printed version and on electronic medium including video recordings) are also protected by intellectual property rights belonging to Business4Good or third parties.
7.2. The Participant is only allowed to use the Program and the Works for its own personal use. Any reproduction, distribution, sale or other exploitation of the Program and/or the Works, by any means whatsoever, is strictly prohibited. This means, inter alia, that the Participant is forbidden to:
- copy or in any other way distribute the Works of the Program, whether for professional or non-professional purposes;
- use the Program and/or the Works to give coaching sessions himself;
- share the Zoom-link with any other person and
- Make recordings of the sessions of the Program.
7.3. The Participant undertakes to refrain from any infringement of the intellectual property rights of Business4Good or entitled third parties and not to use the sign "Business4Good" as a trademark, trade name, domain name or user name on social media. This includes but is not limited to the Participant not using 'Business4Good' in his email address, domain name and/or trade name. Unless otherwise stated, storing information from the Website or related services in a database is prohibited, with the exception of storing these Terms and Conditions or your own orders on your hard drive.
8. Permission to Record the Live Sessions of the Program and to Use the Recordings
The Participant in a live session of the Program knows and accepts that each live session of the Program will be recorded in order to be distributed afterwards to other Participants. To the extent that the image of the aforementioned Participant is visible and/or his voice can be heard during one or more of these sessions, he waives, by accepting these Conditions, if applicable, his right to image and/or right to voice.
8.2 The aforementioned Participant therefore grants his permission to Business4Good to use his/her image and/ or the recording of his/her voice during a live session of the Program to be distributed to other Participants. This permission is given for the exploitation of the recording in the whole world and for the whole duration of the rights of the participant on this recording of his/her image and/or voice.
9. Confidentiality Obligation - Indemnification obligation
9.1 Each Participant undertakes to keep confidential all information about other Participants of which it obtains knowledge during the Program (hereafter: ‘Information’). This Information includes, amongst others, the identity of the other Participants and their personal story.
Each Participant shall indemnify Business4Good for any complaint and any request for damages, whether judicial or not, another Participant would make because of a diffusion or other use caused by the indemnifying Participant of Information shared by the other Participant.
10. Use of Portal and/or Video Conferencing Platform
10.1. Business4Good organises the sessions of the Program by using a portal and a videconferencing platform. Business4Good cannot be held liable for any problems caused by portal and/ or the videconferencing platform which would prevent one or more sessions of the Program to take place at the agreed timing.
10.2 Business4Good reserves the right to change the portal, for example when the evolution of technology and security systems, or the evolution of applicable laws and regulations requires it.
10.3. Business4Good also reserves the right to suspend service through the portal for maintenance or to make adjustments or improvements to the system. Business4Good cannot be held liable for this.
11. Privacy Policy
11.1. You can only place an order through this Website if you agree to provide accurate and complete information about yourself as requested during the ordering process. We value the trust you place in our company and any personal data you give us will be treated with the utmost care and confidentiality.
12. Varia
12.1 If one or more provisions of these Terms and Conditions are void or unenforceable, the remaining provisions will retain their full effect.
13. Applicable Law and Competent Court
13.1 The relations between the Participant and Business4Good are governed solely by Belgian law. Any disputes will be submitted to the Dutch speaking commercial court of Brussels.
